VAT on Property Purchases

The amendment made to the VAT Law 47/1992 and 8/1998 which was published in the Official Gazette on 14th March 2005 states that the VAT rate on purchases of immovable property by non-TRNC citizens will be 15% of the sale value. However purchasers who fall into any of the following categories will continue to pay VAT at the previous rate of 5%:
- Purchasers who made an application to the Council of Ministers for permission to purchase before 31st December 2004 and who effect the transfer of title within 3 months from the date of the Council of Ministers decision to grant the purchase permission.
- Purchasers who obtained permission to purchase from the Council of Ministers before 31st December 2004 and who commenced proceedings to transfer title to the property and who will complete the transfer process by 30th June 2005. |

125 year Leasehold

| The Council of Ministers has confirmed that the proposal to introduce new legislation which would restrict the rights of non TRNC citizens who wish to purchase property in the TRNC to purchasing only 125 year leaseholds has now been officially withdrawn. Non TRNC purchasers will continue to be entitled to purchase full freehold title. |

The Orams Case

The District Court of Nicosia in South Cyprus has ordered Britons, Linda and David Orams to demolish the house they have built in Lapta, Northern Cyprus on pre 1974 Greek land and pay compensation to the original Greek Cypriot owner.
Due the division of the island, this court order cannot be directly enforced against the Orams in Northern Cyprus. Instead, lawyers for the original Greek Cypriot owner are seeking to enforce the judgment against the Orams and their assets in the UK.

Ercan Preparing for Direct Flights

Teams of experts from the TRNC and Turkeys aviation authorities are working around the clock to prepare Ercan for direct flights, the director of the TRNC Civil Aviation Authority confirmed today. Following demands from Britain, France and the USA for direct flights, Ercans suitability for direct flights is being scrutinised by the experts and work to bring the airport up to international standards has already commenced.
The work to be carried out at Ercan Airport will include the extension of the runway from its current 2815 metres to 3500 metres to allow heavier aircraft with a greater wingspan to take off. The baggage handling systems are to be increased from 2 to 4 and increased secruity and safety measures are to be implemented. |

Karpaz Planning Restrictions Implemented

| The Karpaz Decree, aimed at preserving the regions natural, historical and cultural heritage, has now come into force. According to the decree, constructions are not to be permitted within 100 metres of the sea and the construction of touristic and residential sites will be limited to certain zones. The maximum percentage of a piece of land which can contain buildings and the minimum percentage which must be left for green areas will be adjusted and the height of the buildings will also be restricted. The Decree also applies to the Tatlisu, Mersinlik, Kaplica ve Buyukkonuk areas. |

Prime Minsiter Resigns

| The Prime Minister, Mehmet Ali Talat, and his party have resigned from government as of yesterday. With the coalition falling apart, the President is expected to give the new mandate to form a new government to the leader of UBP, the party that was in power prior to the elections in December 2003. The odds for a new coaltion are yet unknown since any coaliton attempt seems likely to reach 25-26 MPs which would prove to be a knife-edge majority in the 50 seat parliement. The current government is going to be in operation until a new government is formed or alternatively until an early election is called. |
